Terms of Service
Version 1.0
These terms are an agreement between you and [to be confirmed] ("we", "us") about your use of the The Little Sprouties mobile app and website at thelittlesprouties.com (together, the "service"). By creating an account or using the service you agree to them. If you do not agree, please do not use the service. How we handle personal information is explained in our Privacy Policy.
The service
The Little Sprouties sends parents and caregivers one small, age-appropriate activity to do with a child, by email, notification and in the app, and lets you save activities, track progress and share them with other parents.
The service is free, and is in testing. We currently charge nothing for it. While it is being tested it may contain errors, change without notice, be reset, or be unavailable at times.
Who can use it
You must be at least 18 years old (or the age of majority where you live) and be a parent, legal guardian or caregiver with the authority to use the service for the children you add. The service is for adults. Children must not create accounts or use the service on their own.
You are responsible for the information you enter about a child. Use a nickname or first name, and do not enter sensitive information such as health details or a surname.
Your account
Give us accurate information and keep your sign-in details secure. You are responsible for what happens under your account. Tell us at support@thelittlesprouties.com if you think someone else has used it. If you sign in with Google or Facebook, that provider's terms apply to that sign-in.
Activities are ideas, not advice
The activities are general suggestions for play and learning. They are not medical, developmental, therapeutic or educational advice, and they are not a substitute for a paediatrician, therapist, teacher or other professional. Every child is different, and you are best placed to judge whether an activity suits yours.
Please keep children safe:
- Supervise your child at all times during an activity, and stay within arm's reach with babies and toddlers.
- Check the space and any items you use for hazards first, especially small parts, cords, water and heat.
- Stop if a child is upset, unwell or at risk, and follow any safety notes shown with an activity.
- In an emergency, contact your local emergency services.
Play carries some inherent risk. To the extent the law allows, you accept that risk and are responsible for how you carry out activities.
Free now, paid plans possibly later
We may introduce paid plans in future. If we do, we will tell you first, and you will not be charged unless you choose a paid plan. Anything sold through the Apple App Store or Google Play is also subject to that store's terms, including its rules on billing and refunds.
Acceptable use
You agree not to:
- break the law or anyone's rights when using the service;
- copy, scrape, or use automated tools to collect the library, or use it to build a competing product or dataset;
- reverse engineer the app, or interfere with, overload or try to get around the security or limits of the service;
- give false information, or create accounts or referrals to gain rewards unfairly;
- upload or share anything harmful, abusive or unlawful.
Our content
The activities, text, videos, images, designs and software in the service belong to us or our licensors and are protected by law. We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use them for your own non-commercial use with the children in your care. You may share activities using the sharing features in the service. You may not sell, republish or otherwise use them commercially without our written permission.
Your content and feedback
You keep ownership of what you enter, such as nicknames, ratings and comments. You give us a worldwide, royalty-free licence to store, process and use it as needed to run, protect and improve the service. If you send us ideas or suggestions, we may use them without obligation to you. We may remove content that breaks these terms.
Emails and notifications
By creating an account you agree that we may send you the service messages that make the service work, such as your daily activity by email and notification. You can turn these off in settings, use the unsubscribe link in any activity or summary email, or switch off notifications in your phone. We may still send essential messages about your account, security or these terms.
Referrals
You may share your referral code for personal use. Rewards are granted automatically when a referral passes our checks, have no cash value, and may be changed or ended at any time. We may withdraw a reward, and end an account's participation, if we find self-referrals or other abuse.
Third-party services
The service relies on third parties, such as sign-in, email, hosting and app-store providers. Their terms apply to their services, and we are not responsible for them.
Changes to the service, and ending your use
We may change, suspend or stop any part of the service, including the testing period, and will give reasonable notice where we can. You can stop using the service at any time, and can delete your account yourself, in the app or at thelittlesprouties.com/delete-account, or ask us to by emailing support@thelittlesprouties.com (see the Privacy Policy for what is deleted). We may suspend or end your access if you break these terms or if your use puts the service or others at risk. Sections that by their nature should continue, such as those on our content, disclaimers, liability and governing law, will continue after your account ends.
Disclaimers
To the extent the law allows, the service and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including that the service will be uninterrupted or error-free, or that any activity is suitable for your child.
Limit of our liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from your use of the service. Our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim (nothing, while the service is free) and US$50.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or your rights as a consumer under the law where you live.
Your responsibility
To the extent the law allows, you are responsible for claims, losses and costs that arise from your breach of these terms or your misuse of the service.
App stores
If you got the app from the Apple App Store or Google Play, these terms are between you and us, not Apple or Google. Apple and Google have no duty to provide maintenance or support for the app, and are not responsible for claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms as they apply to the iOS app and may enforce them against you. You must also follow the store's usage rules.
Changes to these terms
We may update these terms. Each update is published as a new version with an effective date, and earlier versions stay available on this page. For material changes we will tell you by email or in the app at least 30 days before they take effect, where we reasonably can. If you keep using the service after a change takes effect, you accept the new terms. If you do not agree, stop using the service and delete your account.
Governing law and disputes
These terms are governed by [to be confirmed]. Before starting a formal claim, please email support@thelittlesprouties.com so we can try to resolve the matter informally within 30 days. This does not remove any mandatory consumer protections of the country where you live.
General
These terms, with the Privacy Policy, are the whole agreement between you and us about the service. If part of them is found unenforceable, the rest still applies. If we do not enforce a term, that does not waive it. You may not transfer your rights under these terms; we may transfer ours as part of a sale or reorganisation of the business. We may give you notices by email or in the app.
